General Terms and Conditions (GTC) – arte binningen

1. Subject and Application of the GTC

These General Terms and Conditions (GTC) govern the relationship between arte binningen and the participants. An organising committee (OC) is responsible for the organisation and implementation of the event. Decisions made by the OC are final and cannot be appealed. The GTC form an integral part of every registration.

2. Exhibits and Exhibition Space

Sculptures and Plastics:

Each participant is provided with an exhibition area of 4 m in length and approx. 1.5 m in depth. Pedestals for displaying the exhibits are not provided by arte binningen.

Paintings and Photographs:

Each participant is provided with one display wall measuring 4 × 2.5 m (front wall) and one measuring 1 × 2.5 m (side wall). Exhibits may not be hung on top of each other. Canvases must be painted on the sides. Only exhibits with a maximum width of 70 cm may be hung on the side wall. Exceptions must be requested in writing from the OC and approved by it.

Equipment:

One side table (white, 55 × 55 cm) and one portfolio stand (102 × 60 × 27 cm) are provided by arte binningen. Participants may not bring their own furniture, except for pedestals for sculptures. Works placed in the portfolio stand may not exceed 50 × 70 cm, must be protected, and must display a sales price.

Content Requirements:

Works with racist, discriminatory, violent, or pornographic content, as well as copies or forgeries, are not permitted. Artists are responsible for obtaining permission for any copyrighted material.

3. Participation Fee

The participation fee is CHF 370.00.

4. Payment Terms

After receiving the final confirmation of participation, the participation fee must be paid in Swiss francs within 30 days of invoicing to the following account:

5. Sales

A commission of 25% of the sales price is charged on all sales. Sales during the exhibition are handled exclusively by arte binningen. The settlement of sales proceeds and commissions is made no later than 7 days after the end of the exhibition. Sold works are marked with a red dot and remain displayed until the finissage. Reserved works are marked with a green dot; reservations are generally valid for 24 hours. Arte binningen is also entitled to a commission for works sold within three months after the end of the exhibition.

6. Liability

Arte binningen assumes no liability for damage, loss, or theft of the exhibited works during transport, setup, exhibition, or dismantling. Insurance of the artworks is the responsibility of the participants.

7. Data Protection

Artist and sponsor data are used exclusively in connection with arte binningen. Data is only passed on to third parties with the explicit consent of the responsible company or person.

8. Cancellation

For cancellations up to a maximum of 3 months before the start of the exhibition, 60% of the participation fee will be refunded. For cancellations less than 3 months before the start of the exhibition, no refund will be issued.

9. Import and Export

Participants are requested to contact customs or the relevant authorities of their country regarding questions about the import and export of artworks.

10. Place of Jurisdiction

Swiss law applies. The place of performance and exclusive place of jurisdiction is Binningen.
